The Current Enforcement Landscape
The Software Freedom Conservancy has ongoing enforcement actions against major technology companies for GPL violations in products including television sets, networking equipment, and automotive systems. The SFC's member projects — including BusyBox, Linux (through the Software Freedom Law Center), and others — provide standing for enforcement actions that individual maintainers could not pursue. The SFC has sued Vizio for alleged GPL violations in its television operating system in a case that established important precedent for who has standing to sue for GPL enforcement in the United States.
In Europe, gpl-violations.org and the FSFE (Free Software Foundation Europe) have been active enforcers for decades. The Orange S.A. case (February 2024) — €900,000+ in damages — demonstrated that European courts will award significant damages for GPL violations, not just injunctions requiring compliance.
The Products Most at Risk
License enforcement actions concentrate in three product categories. IoT and consumer electronics devices typically contain embedded Linux and open source utilities (BusyBox, uClibc, etc.) whose GPL obligations manufacturers frequently fail to meet. Automotive systems are increasingly software-defined and frequently incorporate copyleft-licensed components in infotainment and driver assistance systems. Networking equipment — routers, switches, and access points — commonly uses Linux-based operating systems with obligations that many manufacturers have historically ignored.
